Reclaim Photography West Midlands 2016 Project Rules

The exhibition is open to EVERYONE, 16 years and older, professional and amateur photographers alike.

To qualify for participation in the exhibition, you must be 16 years of age.

Entries for young persons aged 16 years and under 18 years on 01 September 2015 must also be signed by a parent or legal guardian.

1. By entering the exhibitions, you hereby accept these rules.

2. Entries must be submitted no later than the deadline listed on the exhibitions submission page.

3. By entering the exhibitions, you agree and acknowledge that Reclaim Photography West Midlands 2016 is permitted to receive and review your registration data. Participants agree that personal data including, but not limited to, name, mailing address, phone number, and email address may be collected, processed, stored and otherwise used for the purposes of conducting and administering this photo competition. At any time, participants have the right to access, review, rectify or cancel any personal data held by Reclaim Photography West Midlands 2016 by sending an email via the following address: www.reclaimphotographywestmidlands.com.

4. Photographs must be your own work.

5. Photographs can be black and white or colour.

6. Photographs can be landscape, portrait or square format.

7. Photographs must be unmounted paper size A4 (201mm x 297mm) maximum 300gsm. The images may be smaller than the paper size.

8. To enter the exhibitions, you must complete and sign the submission form, complete the label template, and submit these with your chosen prints, in order to be considered for the exhibitions.

9. You must include: photographer name, address, daytime telephone number, email address, name of company, institution or organisation (college, university, club, group, society) if applicable, signature(s) and date.

10. You must complete and submit one label, which must be no wider than the width of the print (201 or 297mm) and must include: photographer name, town/city (UK residents), country (international participants), Reclaim Photography West Midlands 2016, sponsor details and charity logo.

11. The label should include: title of work (indicating if it is part of a series if relevant), website or blog url, name of company, institution or organisation (college, university, club, group, society) if applicable. The label should be printed on white card maximum weight 175 gsm.

12. For portrait and building/location/property entries, you will be required to complete and retain a model, minor and building/location/property release form stating that you have full permission to enter and reproduce an image of the person(s) and building(s)/location(s)/property(ies) featured in the photographs. If a selected portrait contains an image of a minor (person under the age of 18) then photographers will be required to complete a minor release form signed by the parent or legal guardian of the minor.

13. All entries must be received by post by 16:00 GMT Friday 26 February 2016 (UK time).

14. Proof of posting will not be accepted as proof of receipt.

15. Receipt of entries delivered by post or courier cannot be confirmed. All applicants requiring proof of delivery are advised to use a recorded delivery service. The responsibility for damage or loss, however caused, is the responsibility of the photographer. You are therefore advised to arrange adequate insurance cover against such risks. You acknowledge that Reclaim Photography West Midlands 2016 and its charity, directors, employees, members, officers, partners, sponsors, stewards, supporters, venues, shall not be liable for any loss or damage, whether or not caused by their negligence.

16. All costs incurred by postal/courier services (including customs charges and any import duties) must be paid for in advance by the photographer. Reclaim Photography West Midlands 2016 will refuse to take delivery of any work that may incur charges to them or their sponsors.

17. All entries will be reviewed and pre-screened by Reclaim Photography West Midlands 2016 project team.

18. You agree that the photographs submitted may be exhibited as part of the Reclaim Photography West Midlands 2016 exhibitions at any of the participating venues.

19. You agree that Reclaim Photography West Midlands 2016 is entitled to pass on your contact details, or your representatives, to the exhibition sponsors and partners, solely for the purpose of enabling the sponsors and partners to make enquiries about purchasing or commissioning photographs from the photographer.

20. Reclaim Photography West Midlands 2016 reserves the right, in its sole discretion, to disqualify and remove any photograph that does not comply with the following requirements, even after the photograph appears on the website. You warrant, in respect of the photographs submitted by you, as follows:

20.1 You are the sole copyright owner and creator of the photographs.

20.2. You have the right to enter your photographs in this exhibitions.

20.3. To the best of your knowledge, the photographs do not contain any infringing, threatening, false, misleading, abusive, harassing, libellous, defamatory, vulgar, obscene, scandalous, inflammatory, pornographic or profane content.

20.4. To the best of your knowledge, the photographs do not contain any material that could constitute or encourage conduct which would be considered a criminal offense, give rise to civil liability, or otherwise violate any law.

21. The photographs do not infringe upon the copyrights, trademarks, contract rights, or any other intellectual property rights of any third person or entity, or violate any person's rights of privacy or publicity, and your photograph does not include:

21.1. Trademarks owned by third parties.

21.2. Copyrighted materials owned by third parties.

21.3. Names, likenesses or other characteristics identifying celebrities or other public figures, living or dead.

21.4. Entries in which you have purchased or secured the rights to use stock images.

22. You agree to fully indemnify Reclaim Photography West Midlands 2016 in respect of all royalties, fees and any other monies owing to any person by reason of your breaching any of the foregoing.

23. The responsibility for damage or loss, however caused, is the responsibility of the photographer. You are therefore advised to arrange adequate insurance cover against such risks. You acknowledge that Reclaim Photography West Midlands 2016 and its charity, directors, employees, members, officers, partners, sponsors, stewards, supporters, venues, shall not be liable for any loss or damage, whether or not caused by their negligence.

24. Reclaim Photography West Midlands 2016 recognises you retain full ownership of the copyright in each photograph that you have submitted.

25. All entrants agree that all photographs submitted to the exhibitions may be reproduced and used to conduct and promote Reclaim Photography West Midlands 2016. Therefore, you hereby grant Reclaim Photography West Midlands 2016 with a right to use submitted photographs in the framework of such promotional activities, as Reclaim Photography West Midlands 2016 exhibitions exists in part to raise the profile of the exhibiting artists.

26. You agree to participate in related publicity and to the use of your name and images for the purposes of marketing, promotion, discussion and education in direct connection with Reclaim Photography West Midlands 2016 and the exhibitions, in all media worldwide including the exhibition programme, posters, the Internet and within television documentaries, and may license these specific, limited rights to others only for the same purposes, without additional compensation. Reclaim Photography West Midlands 2016 also reserves the right to reproduce selected images for core non-commercial purposes, for example, in the past Exhibitions page of a gallery website, indefinitely as a public record. Such requests will not be unreasonably withheld.

27. The processes of the exhibition may be filmed and photographed, and entering the exhibition constitutes agreement for the prints and labels to be included in such filming and photography, whether broadcast or not.

28. Any photograph used by Reclaim Photography West Midlands 2016 shall carry a credit line. Any failure to provide such credit line shall not be deemed to be a breach, as long as Reclaim Photography West Midlands 2016 uses its reasonable endeavours to rectify such failure within a reasonable period from the date of notice of such failure.

29. You acknowledge that Reclaim Photography West Midlands 2016 and its charity, directors, employees, members, officers, partners, sponsors, stewards, supporters, venues, assume no responsibility and are not liable for any image misuse.

30. Reclaim Photography West Midlands 2016 assumes no responsibility for any incorrect, inaccurate or incomplete information, whether caused by website users or by any of the equipment or programming associated with or utilised in the exhibition, and Reclaim Photography West Midlands 2016 assumes no responsibility for technical, hardware or software failure of any kind, for lost network connections, garbled computer transmissions, other problems or technical malfunctions with regard to the exhibitions. Reclaim Photography West Midlands 2016 assumes no responsibility for any error, omission, corruption, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of entries. Reclaim Photography West Midlands 2016 is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, computer equipment, software, failure of any e-mail addressed to Reclaim Photography West Midlands 2016 on account of technical problems, human error or traffic congestion on the internet or any website, or any combination thereof, including any injury or damage to your or any other person's computer related to or resulting from participation or downloading any materials in the project. If for any reason a participant's photograph cannot be viewed or is not capable of running as planned, including infection by computer viruses, bugs, tampering, unauthorized intervention, fraud or technical failures, Reclaim Photography West Midlands 2016 assumes no responsibility.

31. In no event will Reclaim Photography West Midlands 2016, charity, directors, employees, members, officers, partners, sponsors, stewards, supporters, venues, be responsible or liable for any damages or losses of any kind, including direct, indirect, incidental, consequential, special or punitive damages arising out of any participant’s access to and use of the website and participation in the exhibitions. Without limiting the generality of the foregoing, everything on the Website, blog and social media is provided "as is", without warranty of any kind, either express or implied, including but not limited to, the implied warranties of merchantability, fitness for purpose or use or non-infringement.
